一、民法典中附条件的赠与合同什么时候生效

附条件的赠与合同,自所附条件达成时,赠与合同就生效,当事人要履行赠与合同的义务。

《中华人民共和国民法典》

第一百五十八条 【附条件的民事法律行为】民事法律行为可以附条件,但是根据其性质不得附条件的除外。附生效条件的民事法律行为,自条件成就时生效。附解除条件的民事法律行为,自条件成就时失效。

第六百五十七条 【赠与合同定义】赠与合同是赠与人将自己的财产无偿给予受赠人,受赠人表示接受赠与的合同。

 

二、赠与合同的任意撤销有哪些限制

赠与合同的任意撤销,是指赠与合同成立后,赠与人按照自己的意思而撤销赠与。

由于赠与合同具有无偿性,所以法律允许赠与人任意撤销。由于这种撤销具有任意性,如果不对其加以限制,则等于赠与合同对当事人没有任何约束力,因此,对赠与合同的任意撤销有以下几方面的限制:

(1)可以任意撤销的赠与合同仅限于一般的赠与合同。

(2)撤销必须在赠与财产权利转移之前做出。

赠与合同的任意撤销权是指赠与人在赠与财产的权利转移之前可以撤销赠与。

其限制是具有救灾、扶贫等社会公益、道德义务性质的赠与合同或者经过公证的赠与合同不适用任意撤销权。

1、 When does a conditional gift contract in the Civil Code come into effect


A conditional gift contract shall become effective upon the fulfillment of the attached conditions, and the parties shall fulfill their obligations under the gift contract.

Article 158 [Conditional Civil Legal Acts] Civil legal acts may be conditional, except for those that cannot be conditional based on their nature. Civil legal acts with effective conditions shall take effect from the time the conditions are met. Civil legal acts with conditions for termination shall become invalid upon the achievement of the conditions.


Article 657 [Definition of Gift Contract] A gift contract is a contract in which the donor gives his own property to the donee free of charge, and the donee expresses acceptance of the gift.


2、 What are the restrictions on the arbitrary revocation of gift contracts


The arbitrary revocation of a gift contract refers to the revocation of the gift by the donor according to their own will after the gift contract is established.


Due to the gratuitous nature of the gift contract, the law allows the donor to revoke it arbitrarily. Due to the arbitrariness of this revocation, if it is not restricted, it means that the gift contract has no binding force on the parties. Therefore, there are several limitations on the arbitrary revocation of the gift contract:


(1) The gift contracts that can be revoked arbitrarily are limited to general gift contracts.


(2) Revocation must be made before the transfer of property rights to the gift.


The arbitrary revocation right of a gift contract refers to the donor's right to revoke the gift before the transfer of rights to the gift property.


Its limitation is that gift contracts with social welfare and moral obligations such as disaster relief and poverty alleviation, or gift contracts that have been notarized, do not apply to the right of arbitrary revocation.
