如何确定运输合同纠纷案件的管辖法院?
在铁路、公路、水上、航空运输和联合运输合同发生的纠纷,不同于一般的合同纠纷,即包括一方不履行合同发生的纠纷,如无故拖延运输期限,又包括在运输过程或者到达目的地时,托运的物品被损坏、丢失,或者对运输工具、设备造成损害,以及旅客人身遭受损害所发生的赔偿纠纷。因此,与《民事诉讼法》第24条和25条规定的合同纠纷。这类合同纠纷,可能发生在运输合同始发地、中转地、也可能发生在运输到达地。当事人因为上述运输合同发生纠纷,经过双方协商,可以自行解决,也可以向仲裁机构申请仲裁。如果提起诉讼,根据我国《民事诉讼法》第28条规定,“因铁路、公路、水上、航空运输和联合运输合同纠纷提起的诉讼,由运输始发地、目的地或者被告住所地人民法院管辖。”
运输始发地、是指货物运输的发运地或者旅客乘运地。目的地,是指货物或者旅客到达地。上述3个地方各人民法院对这类运输合同纠纷都有管辖权,当事人到任何一个法院起诉都可以。有管辖权的人民法院不得无故推托,应当依法受理。对两上以上有管辖权的人民法院,当事人只能选择其中一个法院起诉,由最先受理的人法院审理。

Disputes arising from railway, road, water, air, and intermodal transportation contracts are different from general contract disputes. They include disputes arising from one party's failure to perform the contract, disputes arising from unreasonable delay in transportation, damages or losses to the consigned goods during transportation or upon arrival at the destination, or damages to the transportation vehicle or equipment, as well as compensation disputes arising from personal injury to passengers. Therefore, the contract disputes stipulated in Articles 24 and 25 of the Civil Procedure Law. This type of contract dispute may occur at the place of origin, transit, or destination of the transportation contract. The parties involved may resolve any disputes arising from the aforementioned transportation contract through mutual consultation or apply for arbitration to an arbitration institution. If a lawsuit is filed, according to Article 28 of China's Civil Procedure Law, "Lawsuits arising from disputes over railway, highway, water, air, and combined transportation contracts shall be under the jurisdiction of the people's court at the place of origin, destination, or defendant's domicile of the transportation."
The origin of transportation refers to the place of shipment of goods or the place of passenger transportation. Destination refers to the place where goods or passengers arrive. The people's courts in the above three places have jurisdiction over such transportation contract disputes, and the parties can file a lawsuit in any court. The people's court with jurisdiction shall not unreasonably withhold and shall accept it in accordance with the law. For two or more people's courts with jurisdiction, the parties can only choose one court to bring a lawsuit, and the court that first accepts the case shall hear it.
