合同的履行,指的是合同规定义务的执行。任何合同规定义务的执行,都是合同的履行行为;相应地,凡是不执行合同规定义务的行为,都是合同的不履行。因此,合同的履行,表现为当事人执行合同义务的行为。当合同义务执行完毕时,合同也就履行完毕。而合同履行又包括了哪些内容呢?下面有小编为大家详细的讲解一下。

一、合同履行是当事人的履约行为。

二、履行合同的标准

履行合同,就其本质而言,是指合同的全部履行。只有当事人双方按照合同的约定或者法律的规定,全面、正确地完成各自承担的义务,才能使合同债权得以实现,也才使合同法律关系归于消灭。因而,当事人全面、正确地完成合同义务,是对当事人履约行为的基本要求。只完成合同规定的部分义务,就是没有完全履行;任何一方或双方均未履行合同规定的义务,则属于完全没有履行。无论是完全没有履行,或是没有完全履行,均与合同履行的要求相悖,当事人均应承担相应的责任。

三、履行合同的行为过程

当事人完成合同义务的整个行为过程,不仅包括当事人的依约交付行为,而且还应包括当事人为完成最终交付行为所实施的一系列准备行为。尽管在通常情况下,准备行为并非合同义务,但绝不能因此得出准备行为不是合同履行行为的结论。准备行为是最终履行行为的基础或前提,甚至可以说没有准备行为即没有最终的履行行为。合同的履行是一个过程,这其中包括执行合同义务的准备、具体合同义务的执行、义务执行的善后等。在这一过程中,具体合同义务的执行是合同履行的核心内容,传统意义上的合同履行,指的就是这一阶段的合同履行。然而,为执行合同义务所作的准备和义务执行完毕后的善后义务,固然不是合同规定的义务,但因其与第二阶段意义上的合同履行具有密切的联系,也是合同履行的内容。这同时也是现代合同法发展的趋势所在。
