事实劳动关系时间是怎样确定的How is the time of factual labor relations determined
事实劳动关系证明:事实劳动关系是指无书面合同或无有效书面合同形成的劳动雇佣关系以及口头协议达成的劳动雇佣关系。事实劳动关系的确认需存在雇佣劳动的事实存在。“事实劳动关系”合法地位,确认了劳动关系不依赖书面合同的存在而存在,扩大了劳动保护范围,对不签定劳动合同的雇主有了更大约束,更多的维护了劳动者的合法权益。
如何判断是否已经形成了事实劳动关系?如果劳动者发现用人单位没有与自己签订劳动合同的,就要注意收集以下证据了,以备不时之需。
(一)工资支付凭证或记录(职工工资发放花名册)、缴纳各项社会保险费的记录。
(二)用人单位向劳动者发放的“工作证”、“服务证”等能够证明身份的证件。
(三)劳动者填写的用人单位招工招聘“登记表”、“报名表”等招用记录。
(四)考勤记录。
(五)其他劳动者的证言等。
对劳动中擦认定的存在劳动关系不服,可以自收到仲裁裁决书之日起十五日内向人民法院提起诉讼。
《劳动争议调解仲裁法》第五十条 事人对本法第四十七条规定以外的其他劳动争议案件的仲裁裁决不服的,可以自收到仲裁裁决书之日起十五日内向人民法院提起诉讼;期满不起诉的,裁决书发生法律效力。
第四十七条 下列劳动争议,除本法另有规定的外,仲裁裁决为终局裁决,裁决书自作出之日起发生法律效力:
(一)追索劳动报酬、工伤医疗费、经济补偿或者赔偿金,不超过当地月最低工资标准十二个月金额的争议;
(二)因执行国家的劳动标准在工作时间、休息休假、社会保险等方面发生的争议。

How to determine whether a factual labor relationship has been formed? If workers find that the employer has not signed a labor contract with them, they should pay attention to collecting the following evidence for future needs.
(1) Salary payment vouchers or records (employee salary distribution roster), and records of paying various social insurance premiums.
(2) Employers issue identification documents such as work permits and service permits to workers.
(3) Recruitment records such as the "Registration Form" and "Application Form" filled out by the employer by the employee.
(4) Attendance records.
(5) Testimonies of other workers, etc.
If you are dissatisfied with the existence of labor relations determined by friction in labor, you may file a lawsuit with the people's court within 15 days from the date of receiving the arbitration award.
Article 50 of the Labor Dispute Mediation and Arbitration Law: If a party is dissatisfied with the arbitration award of labor dispute cases other than those stipulated in Article 47 of this Law, they may file a lawsuit with the people's court within 15 days from the date of receiving the arbitration award; If no lawsuit is filed at the expiration of the period, the award shall have legal effect.
Article 47: Except as otherwise provided in this Law, the arbitration award for the following labor disputes shall be final and the award shall take legal effect from the date of its making:
(1) Disputes over the recovery of labor remuneration, work-related injury medical expenses, economic compensation or compensation, which do not exceed the local minimum monthly wage standard of twelve months;
(2) Disputes arising from the implementation of national labor standards in areas such as working hours, rest and vacation, and social insurance.
