劳动争议仲裁申请书怎么填写How to fill out the labor dispute arbitration application form

申请人申请仲裁应当提交书面仲裁申请,并按照被申请人人数提交副本。仲裁申请书应当载明下列事项:

(一)劳动者的姓名、性别、年龄、职业、工作单位和住所,用人单位的名称、住所和法定代表人或者主要负责人的姓名、职务;

(二)仲裁请求和所根据的事实、理由;

(三)证据和证据来源、证人姓名和住所。书写仲裁申请确有困难的,可以口头申请,由劳动争议仲裁委员会记入笔录,并告知对方当事人。

The applicant shall submit a written arbitration application and provide copies according to the number of respondents when applying for arbitration. The arbitration application shall specify the following matters:


(1) The name, gender, age, occupation, employer and residence of the employee, the name and residence of the employer, and the name and position of the legal representative or main person in charge;


(2) Arbitration request and the facts and reasons on which it is based;


(3) Evidence and sources of evidence, names and addresses of witnesses. If there are difficulties in writing an arbitration application, an oral application can be made, and the labor dispute arbitration commission shall record it in writing and inform the other party.
