遭受家庭暴力一方是有权请求损害赔偿的，根据我国《婚姻法》及其司法解释的相关规定，由于因家庭暴力导致离婚案件，无过错方可以要求有过错一方进行家庭暴力离婚赔偿。
家庭暴力离婚赔偿的侵害对象是人身损害，赔偿范围是物质损害赔偿和精神损害赔偿两个方面。在家庭暴力情形下。这里物质损害主要包括由于身体、精神受到伤害而产生的医疗费，误工费、残疾者生活补助费等等。精神上痛苦是极其主观的感受，别人无从得知，从而精神损害不可能精确计算，只能委之于法官凭借司法经验，根据行为人的主观恶意、情节、常理、医学鉴定等因素予以判断。下面是司法实践中运用的一些原则：
(一)无过错方作为原告向人民法院提起家庭暴力离婚赔偿请求的，必须与离婚诉讼同时提出。
(二)无过错方作为被告的离婚诉讼案件，一审时被告没有提出家庭暴力离婚赔偿，在二审时提出来的，人民法院应当进行调解，调解不成的，告知当事人在离婚后一年内另行起诉。
(三)无过错方作为被告的离婚诉讼案件，如果被告不同意离婚也不提起家庭暴力离婚赔偿的，可以在离婚后一年内就家庭暴力离婚赔偿问题单独提起诉讼。
