在起诉第一审经济合同纠纷案件时,须提供下列一般证明、证据:
(1)企业法人、个人合伙、个体工商户的资格证明(营业执照原件,如是复制件,须与原件核对并加注明后,将原件退还),开户银行和帐号。起诉状上的原、被告名称,须与营业执照、合同章相符合,如不一致或被告主体已变更、合并、关闭,需加以说明,并提供被告现在的准确所在地。
(2)法人的法定代表人、委托代理人的身份证明,授权委托书必须写明代理事项和代理权限。
(3)合同及与合同有关的文书、电报、信函(包括信封)、图表;变更、补充合同的协议、合同和其他附件,合同签订地及其证明材料。应提供原件,复制件须经过核对。
(4)送货、提货、托运、运输、验收、发票等凭证。

(1)建设、建筑工程承包合同纠纷,须提供:国家批准的投资计划、计划任务书、工程承包单位营业执照的原件(如复制件,须与原件核对无误,并加注明后,将原件退还)、技术级别证书,建筑许可证、工程决算书及其审核意见书和工程验收报告等。
